Welcome to OpenRate (ABN 69 869 368 135). These Terms and Conditions (Terms) govern your use of our contract platform and application when you upload your initial quotes and utilize our services. By accessing or using OpenRate, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our platform.

1. Job Poster Contract

By uploading your initial quote on OpenRate, you agree to abide by these Terms and provide accurate and truthful information. You are responsible for ensuring that all details related to your quote are complete and correct.

2. Our OpenRate Platform

How OpenRate Works

OpenRate is a free platform for users to upload their initial quotes and connect with tradies (tradespeople). Tradies pay to be listed on our platform, enabling them to receive job quotes and compete for your business.

Important Points:

  • OpenRate does not partner, employ, or contract tradies.
  • We do not set the prices for tradies work.
  • OpenRate facilitates connections between users and tradies.

Tradies on OpenRate

Tradies on our platform are independent professionals. They are responsible for their work quality and pricing. Your relationship with tradies is directly between you and the tradie you choose.

3. Uploading Your Initial Quote

To upload your initial quote:

  1. Provide comprehensive details about your job, including scope, location, and budget.
  2. Upload any relevant files or photos to help tradies understand the project.
  3. Submit your quote for tradies to view and respond with their offers.

4. Connecting You with Tradies

Once your initial quote is uploaded:

  • Tradies review your quote details.
  • If interested, tradies submit their offers for your consideration.
  • You receive multiple offers, allowing you to choose the best fit based on price, quality, and reviews.

5. Tradie Checks

How We Verify Tradies

When a tradie joins OpenRate, we:

  • Verify their Australian Business Number (ABN).
  • Check for any required trade licenses based on their category.
  • Perform daily checks against the ABN register and CreditorWatch™ to ensure legitimacy.

Your Responsibility

While we perform initial checks, you should:

  • Verify that the tradie has the necessary skills, experience, and qualifications for your job.
  • Review the tradies licenses, insurances, and previous work before hiring.

Actions We Take

We monitor tradies for compliance:

  • Tradies with repeated negative feedback or unlicensed work are banned from our platform.
  • We do not tolerate fraudulent or unprofessional behavior.

6. Hints and Tips

Creating a Great OpenRate Experience

Uploading Your Quote

Step 1. Once you have prepared your initial quote, upload it into our system. Our smart system automatically extracts all the necessary details from your quote, such as location, price, and scope of work. At the same time, it ensures your personal information—like your full name, phone number, and address—is securely hidden. We prioritize your privacy and do not share any private information unless you explicitly choose to share it with a tradie. This form will be sent in a few seconds to all independent tradies covering your area without any limitations. The initial quote should meet our criteria; if not, one of our operators could give you a call to double-check some details or the scope of work.

Step 2. Tradies who receive the quote will review the scope of work, and if they can offer a better price for the same quality of work, they will upload their offer into our system. Once all offers are received, our smart system will generate a smart report with all the quotes and tradies listed. You will then be notified that all offers have been received and the report is ready for review.

We do not share your private information and do not connect you with the tradies before you get the full report and choose the tradie. We do not limit the tradies to make the offer, like other services do. You will receive as many competitive offers as provided by different tradies.

Step 3. Review the smart report and choose the best deal by comparing the whole market based on important indicators like price, warranty, availability, and reviews.

Step 4. Get contacted by the tradie you choose and schedule the job to be done.

Step 5. Rate the tradie after the job is done to help others like you make the right decision.

Why Have not I Received Competitive Offers?

Sometimes we are unable to get competitive offers for the same quality job. If this happens, we will let you know and provide you with details of some tradies you can contact directly. No offers can occur for many reasons:

  • Tradies were unsure about your job.
  • There aren’t many tradies who do that kind of work in your area.
  • Tradies are fully booked or too busy with other things to provide an offer.

7. Misunderstandings and Disputes

Handling Disputes

While OpenRate is not a party to the contract between you and the tradie, we strive to facilitate positive connections. Our Trust & Quality team can assist in resolving issues by:

  • Communicating with both parties.
  • Allowing tradies to remedy their work where possible.
  • Referring unresolved disputes to appropriate regulatory bodies or tribunals.

Your Role

Ensure clear communication with tradies regarding job expectations and requirements to minimize misunderstandings.

8. Ratings and Feedback

After completing a job, rate the tradie to:

  • Provide feedback for the tradie.
  • Help future users make informed decisions.
  • Maintain the quality and reliability of tradies on our platform.

9. Platform Content and Protection

Intellectual Property

OpenRate owns all copyright in the platform, including content you publish or upload. You may not commercialize OpenRate content or assist others in doing so.

Protecting Our Platform

You must not:

  • Mine data from OpenRate.
  • Overload our infrastructure.
  • Tamper with the platforms operation.
  • Upload malicious software like trojans or viruses.

10. Account Cancellation & Suspension

Account Access

We may suspend or terminate your access to OpenRate if:

  • We believe it is necessary to protect others, our reputation, or the platform integrity.
  • You breach our Terms or applicable laws.
  • Your account is compromised.
  • We cease operating the platform.

Notification

We strive to notify you before taking action, but it may not always be feasible.

11. OpenRate’s Limitation of Liability

Consumer Guarantees

Under Australian Consumer Law, you are entitled to certain guarantees, including:

  • Services are provided with due care and skill.
  • Services are reasonably fit for purpose.
  • Services are provided within a reasonable time.

Our platform services relate to connecting you with tradies. However, our services do not include the work performed by your chosen tradie.

Limitation of Liability

OpenRate liability for any loss or damage suffered by you when using OpenRate is limited to:

  • Reproviding our platform services.
  • Paying for the platform services to be re-provided.

We are not liable for:

  • Indirect, incidental, or consequential damages arising from your use or inability to use OpenRate.
  • The work performed by your chosen tradie.

12. Other Important Stuff

Entire Agreement

These Terms constitute the entire agreement between you and OpenRate regarding the use of our platform, superseding any prior agreements or discussions.

Changes to These Terms

We may update these Terms from time to time. We will notify you at least 30 days before making changes. Continued use of OpenRate after changes constitutes acceptance of the new Terms.

Exclusive Programs

If you access OpenRate through an Exclusive Program, specific terms for that program may also apply.

Other Terms Incorporated by Reference

These Terms incorporate by reference our Privacy Policy.
